Concerned I am being railroaded/ bad attorney/ HELP!

Ok- at the risk of sounding paranoid- This attorney I have first told me we should serve my wife divorce papers in front of her class- the kids would get a kick out of it- I said, no, serve her at home quietly.

Now, her attorney has asked for a restraining order against all of our household possessions (I understand that is standard) but she also asked for control of the family residence (which I understand is not typical)   and she want me to pay a large amount of the mortgage. I understand that this is requested in situattions of domestic violence allegations- but I have been gone for 2 and 1/2 months and never went back-  (Remember my wife had put the hidden video cameras around then tried to bait me into fights- which I did not do) and no domestic violence restraining orders have been filed against me at this time.

Anyway, I have been calling around to get a new attorney- 8 people said they were too busy, 2 said that they could schedule me but their retainer would be 10/ 15 thousand dollars. I've never heard of that much of a retainer!! It's like I am now on this blacklist.

And with the really bad advice I think my attorney is giving me- it's almost like I am being set up.

I told him , no, don't say we want the wife and kid out of the house if their is any smell of allegations of abuse from her.  I'll look like a jerk to a judge- even I know that.

What do you thiink is going on???  Any suggestions?

I had to get another attorney in haste before a hearing. This is a new thing for you, and it may take time to learn the ropes, and you may need another lawyer, only you would know that.
You need to get competent legal advice- in my region, it is not unusual for the wife and minir children to retain the marital residence, even until the age the children reach their majority. It is also standard for support to be required when the financial disclosures indicate that this would be according to set guidlines. Only you can know what is right in your case in all of its particulars- competent legal advice is crucial, as well as your getting what information you can as well.
Hope you do all that you can to destress, this situation can be a monster!

What kind of professional attorney would suggest such a course of action in front of a class full of children (she is a teacher?) ? 

Would the children not be shocked?

Now you know who your Judge is..... time to shop around for an attorney that knows you Judge well and has a good repoir with him/her.  Doesn't mean your case is going to go your way but..... it does ensure that you will be heard and at least have a shot at getting a fair shake.

Ask a couple different attorney's who to hire.  Tell them the county and the Judge.  It;s worth the Grand to find out who's who.  

It is entirely possible that you've been black balled btw.  

One attorney says something.... then you're not able to get an appointment with anyone else.   Are you just being paranoid or....... something else?  Hard to say.

Please, do some more homework and don't freak out.  

Make mindful choices and, oh ya.....

I had a fatboy attorney scale my locked fence , scream, threaten and try to break open my door in order to serve something that I wanted to get in the first place! The typr of lawyer that he is , as defined by my attorney, is a "Moron Attorney".

I don't know Whistler's lawyer, so I can't say anything definitively. Only Whistler knows. But it does help to have someone you can get along with. It has also helped me to get good counseling- you can separate issues bettere and deal with ups and downs.
